These Terms & Conditions ("Terms") govern your use of the website, communications, and services provided by Daniel Monzon Automation ("we," "us," or "our"). By using our website, booking a call, or agreeing to receive messages from us, you accept these Terms.
1. Acceptance of terms
If you do not agree with these Terms, please do not use our services. We may update these Terms from time to time as described in Section 9.
2. SMS messaging terms
Daniel Monzon Automation operates text (SMS) messaging as part of the booking and communication services we provide — both for our own business and on behalf of the local businesses we serve.
SMS program details
Program: Booking and appointment messaging from Daniel Monzon Automation. After you opt in, we send transactional texts such as appointment booking links, confirmations, reminders, and follow-up messages.
How you opt in: You opt in through the optional, unchecked SMS-consent checkbox on our online booking form — booking does not require checking it, and you can complete any booking or service without opting in. You may also give consent verbally during a phone call with us or a business we serve; verbal consent is likewise optional. We never add anyone to messaging without consent, and we never require consent to texts as a condition of any purchase or service.
Message frequency: Message frequency varies based on your activity — typically a few messages per appointment or request (about 1–5 messages per booking).
Cost: Message and data rates may apply, depending on your mobile carrier and plan. We do not charge you for the messages.
- To opt out: reply STOP to any message at any time. You'll get one confirmation and then we won't text you again unless you opt back in.

Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's network availability.
Privacy: Your mobile number and SMS opt-in data are handled as described in our Privacy Policy, and are never shared with third parties for their marketing purposes.
3. Our services
We help local service businesses with done-for-you websites and AI automation. Our work includes website design and rebuilds, AI voice agents, online booking, missed-call text-back, follow-up, and review automation. Specific deliverables, scope, and timelines are agreed separately with each client. We work to keep systems running reliably but do not guarantee uninterrupted or error-free operation of third-party tools (such as scheduling, hosting, payment, analytics, or carrier services) that are outside our control. For websites and search presence specifically, we work to improve a site's visibility and performance, but we do not guarantee specific search rankings or results.
4. Payment & the pilot
Project pricing — including any setup fee, monthly service fee, and money-back pilot period — is set out in the proposal or agreement provided to each client before work begins. Invoices are payable as stated in that agreement. The terms of the money-back pilot are described in your individual agreement and take precedence over any general summary on our website.
5. Intellectual property
The content, design, and code of this website are owned by Daniel Monzon Automation. Work product delivered to a client is owned as set out in that client's agreement. You may not copy, resell, or redistribute our materials without permission.
6. Disclaimers
Our website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the services will meet every requirement or be uninterrupted, secure, or error-free.
7. Limitation of liability
To the maximum extent permitted by law, Daniel Monzon Automation is not liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Where liability cannot be excluded, it is limited to the amount you paid us for the services giving rise to the claim.
8. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Florida.
9. Changes to these terms
We may revise these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of our services after a change means you accept the revised Terms.
